These Terms of Service ("Terms") are an agreement between you and Brigade Management, Inc., a Texas corporation ("we", "us"), which operates Dirt to Permit at dirttopermit.com (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you use the Service for a company, you agree for that company and confirm you may bind it.
Who may use it
You must be at least 18 years old. The Service is intended for business and professional use in planning construction projects.
What Dirt to Permit is, and is not
Dirt to Permit is an independent advisory tool. It reads public City of Austin map layers and permit records and estimates what may trigger review and how long a permit may take.
- It is not the City of Austin, is not affiliated with, endorsed by or a service of the City, and does not file, obtain or guarantee permits. The City makes every permitting decision, and its rules change.
- It is not legal, engineering, surveying, architectural, arborist or financial advice. Confirm every requirement with the City and with qualified licensed professionals before you rely on it.
Introductions to professionals. If you ask for help through the get-help form, we may introduce you to an independent professional. That professional is not our employee or agent. We do not supervise, guarantee or take responsibility for their work, licensing, prices or schedule; any agreement for work is between you and them. Check a professional's license with the appropriate Texas board before you hire them.
Data sources and accuracy
Results come from public data published by the City of Austin, including its Open Data Portal and GIS map services, and map images from OpenStreetMap (© OpenStreetMap contributors, available under the Open Database License). Public data can be incomplete, out of date, wrong or unavailable, and forecasts are statistical ranges from past permits. Your permit may take longer or shorter than forecast. We do not guarantee any result.
Your account
Give accurate information, keep your password private, and tell us promptly about any unauthorized use. You are responsible for activity under your account.
Acceptable use
You agree not to: resell or sublicense the Service; scrape, crawl or bulk-download it, or try to get around the free daily limit; reverse engineer it except where the law allows; interfere with or overload it, or probe it for vulnerabilities without permission (report security issues through the contact form); upload anything unlawful or that infringes others' rights; or use it to break any law.
Plans, trials and billing
- Free checks. A limited number of checks per day are free without an account. We may change the limit.
- Trial. Paid plans start with a 14-day free trial and require a payment card.
- Automatic renewal. If you do not cancel before the trial ends, your plan's monthly price, plus any applicable tax, is charged at the end of the trial and then every month on the same date until you cancel.
- Canceling. Cancel any time from Account and billing, which opens Stripe's billing portal. Your plan stays active until the end of the period you have paid for, and no further charges are made.
- Refunds. Fees already paid are not refunded, except where the law requires.
- Price changes. We will give you at least 30 days' notice by email before a price change takes effect at your next renewal; you can cancel before then.
- Payments are processed by Stripe, Inc., subject to Stripe's terms.
Your content
Lots, dates and notes you save are yours. You give us permission to store and process them to provide the Service, and to use them in aggregated, de-identified form to improve the forecast. A share link shows what the share page describes to anyone who has the link, until you turn sharing off.
Our content
The Service, including its software, text, design, logos and the forecast model, belongs to us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use it under these Terms. Dirt to Permit and its logo are our trademarks. Public City of Austin data remains subject to the City's own terms. If you send us suggestions, we may use them without obligation to you.
Changes to the Service
We may change, suspend or stop any part of the Service. If we stop a paid plan, we will refund any prepaid fees for the unused period.
Disclaimers
TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY FORECAST OR FINDING WILL BE CORRECT.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR PROJECT DELAYS, CARRYING COSTS, REDESIGN COSTS, LOST PROFITS OR LOST DATA, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR US $100.
Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you.
Indemnity
If you use the Service for a business, you agree to defend and hold us harmless from third-party claims arising from your misuse of the Service or your breach of these Terms.
Ending the agreement
You may stop using the Service and close your account at any time. We may suspend or close an account that breaks these Terms or puts the Service or others at risk. Sections that by their nature should survive, including content ownership, disclaimers, limitation of liability, indemnity and governing law, survive termination.
Governing law and disputes
Texas law governs these Terms, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Collin County, Texas, and you and we consent to their jurisdiction, unless the law where you live requires otherwise.
General
These Terms and the Privacy Policy are the entire agreement about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in a merger or sale of the business.
Changes to these Terms
We will post changes here and update the date above. For a material change we will email account holders before it takes effect. Continuing to use the Service after that means you accept the change.
